Have you been injured by a reckless driver?

by | Dec 29, 2022 | Motor Vehicle Accidents

Bad drivers are everywhere, and California is no exception. Car crashes are bound to occur, but many of these wouldn’t happen if drivers followed the rules of the road. Reckless driving habits lead to accidents, injuries and death.

Reckless behavior

Until the time when driving is fully automated, there will always be bad drivers. Some of the more dangerous actions include the following:

  • Following too closely behind another car
  • Speeding
  • Texting
  • Driving under the influence of drugs or alcohol
  • Driving while fatigued
  • Weaving between cars
  • Driving on the shoulder

If you notice any of these behaviors, try to stay out of the way of the careless driver. Either speed up or slow down but put some distance between the two of you.

Injuries

Car accidents have many different outcomes. Sometimes, everyone walks away with only minor cuts and bruises. However, other times the damage is much more severe and may result in life-long suffering or death. Injuries may include the following:

  • Broken bones
  • Whiplash
  • Traumatic brain injuries
  • Spinal cord injuries
  • Internal bleeding
  • Anxiety and emotional distress

Be sure to seek medical care for any symptoms appearing after an accident. Brain injuries and internal bleeding may be difficult to detect at the accident scene. If you find yourself suddenly forgetful, unable to sleep, hyperemotional or feeling out of sorts, consult a doctor. Delaying treatment may result in permanent damage.

Compensation

The victim of a reckless driver may be able to receive compensation from the other party’s insurance company. The total amount may take into account the following factors:

  • Physical damage to the vehicle
  • Medical expenses
  • Time lost from work due to injuries
  • Pain and suffering

If the insurance company’s offer isn’t satisfactory, you can file a civil lawsuit against the driver. These types of cases often settle out of court. If that doesn’t happen, a jury decides the outcome.

If a reckless driver has injured you, keep a copy of the accident report, garage estimates and medical expenses. Take the appropriate measures to receive the compensation you deserve.
